My brother says I cant make my own Mystic spore because it would be an illegal game piece. Dose any one know if I can do this legaly?
He said if I make it he can take a block of foam and make it a leman russ tank...
Please let me know

There's one big difference: GW never made a model for the mycetic spore. You have to make one yourself. However, the Leman Russ has several model kits for it. Your brother is being a jerk.
If you want to mess with his head, make a ball-shaped model out of the GW boxes his minis came in, then tell him that it is now legal, due to the fact that you used Games Workshop materials!

If you paper mache some WD or sprue boxes then it is all GW product and therefore legal and since the Mysetic spore hasn't got a model you can either make one or you say you are using the model GW provides and deploy nothing to mess with his head.

The best one that I have seen is a softball stuck on a cd for a base and covered with kidney beans. The guy painted it up to match the colors of his swarm and it looks amazing.
No legal model means you can field anything you like for it.

I used a Carnifex box to create spods and they have had no issue even in tourneys.

Yet another reason NOT to play against a sibling.
The tyranid players in my club both use MegaBloks "dragons universe" large dragon eggs for theirs. Big enough to fit a carnifex into and around $10-12AUD.
