Bethasda has thrown the creator of Minecraft at their loyars, because he created a game called 'scrolls' and Bethesda claims it sounds like 'the Elder Scrolls'. What does dakke think?

Not a big fan of notch's work, love bethesda (sorta, it's complicated), but I think bethesda is slowed for that. You can't copyright a commonly used word like scroll, at least I don't think.

A spectacularly dickish move. There must be some defense in the courts against this right? It just seems so obvious that a larger company could win by war of legal attrition whenever they want.

The reason Mojang is being sued is because people might confuse Scrolls with The Elder Scrolls.

Not sure about anybody else but you would have to be a complete moron to confuse them since TES game usually have the realm your playing in as the big bold word on the case not "The Ekler Scrolls". Feel sorry for Notch tbh.

To be fair, I don't remember the TES games by their series names. Ever. I don't say "Hey, have you played The Elder Scrolls: Morrowind before? What about The Elder Scrolls: Daggerfall, or The Elder Scrolls: Oblivion?" I say "Hey, have you played Morrowind before? What about Daggerfall, or Oblivion?" because they're unique enough for the person i'm talking to to know what i'm going on about, and it saves me unnecessary wasting of breath.

If 'Scrolls' was called 'Morroblivionfall' then yeah, maybe i'd get confused, by 'Scrolls' doesn't make me go "*Gasp* The Elder Scrolls!" it makes me go "hmmm, rolled up pieces of parchment."

Yep, its also how GW operate, or any number of other large companies. You have (or pay) a legal firm that has to justify its existence, so they send C&D's and/or try to sue people that can't/won't represent themselves.

You get a letter that says you will be sued for 2 million dollars, or you can stop doing what you are doing and settle with them for 10k, and a lawyer costs more than that, most companies will just pay them off.

It's just dirtbag tactics that are standard issue for the field but the guys in the chapterhouse thread obviously know a ton more than I do.

In ancient times, you were allowed to challenge the "judicial champion" to a test of strength, and if you won, you were right by might.

I would so love for that to come back in Small Claims Courts with Quake XD

I agree a quake tournament for a lawsuit would be awesome.
