Can the passengers in a vehicle choose a different target from the transport?

Yes. The vehicle and the passengers are separate units.

This exactly mind you the vehicle needs fire points to shoot out of and they may shoot only if the vehicle has moved 0-6" (or in the case of RPJ 7")

Absolutely... two different units. For example this is very handy for my CSM's. They can put a combi-melta on a rhino which has popped more than its share of enemy transports, only to have the templates inside kill anything squishy that managed to escape the flaming wreck.

Because the rules say so?

You can only fire out of ANY vehicle if the vehicle has moved combat speed or less. Period

More than combat speed. Basic Vehicle rules. Even applies to fast, oddly enough.
