Why isnt the meltagun a template? Considering the new Space Marine game treats it as a cone shotgun like attack why cant it be construed as a cone attack? ap1 str 8 template too op?

Much too op. Also, it is a cone, but very short range.
I think you're making a mistake in assuming the tabletop game follows the rules of the video game. Tabletop came first, established how their melta gun works, and the video game took some creative liberties. The video game kind of combined a melta with a flamer.
Reality is a nice place to visit, but I'd hate to live there.

Yeah... game makers take artistic liscense sometimes with demonstrating war game weapons and such in an animated world.
A S8 AP1 melta flame-template assault weapon, that typically costs 5-10 points as an upgrade on a model, would be very broken and unbalance the game.
Meltaguns are short-ranged anti-tank weapons. The shoot a focused but wide beam of heat that melts armor. If it was a template, it would have a lot less strenght and more AP, therefore becoming a heavy flamer. Also, template meltagun would be OP. Also, telling where the melta-range is would be more difficult (unlesss you drew a line on the middle of your template).
Plus in the game a bolter is like shooting a bb gun instead of a mini rocket launcher, and the storm bolter has 300 rounds when it is only a two barrelled bolter with 60rds.

In Kill Team its a ray gun with limitless range, though more effective up close. its basically a focused microwave and while they tend to disperse a little they certainly don't scatter enough to be a template. This of course is based on the assumption that destructive microwaves of the magnitude necessary to melt through armor would react the same way as microwaves used for communication ( which is really how I based my opinion)

Nah, a 5 pt guardsman with a 10 pt upgrade wiping out a whole squad of terminators is totally balanced!
Vehicle mounted Multi-Meltas used to use the small blast template, and could also fire as a Heavy Flamer in 2nd ed.
I would not be opposed to allowing the Meltagun to "Change Focus"
Meltaguns could fire as either as they do currently, or act as a flamer, Multi-Meltas, could also fire as Heavy Flamers.
I don't think it'd be too game breaking.
