There is an exception. The unit that wrecks/destroys a transport may charge the passengers.

Unit A shoots a transport, but does not wreck/destroy it. Then Unit B shoots and wrecks the transport. Unit B may charge the passengers but unit A may not.

Yes, it is a specific exception to the normal rules, and an explicit change to 4th.

Note that, out of the units that shot at the vehicle, ONLY the unit that destroyed the vehicle can assault the passengers.
