Ok, here's the scenario:
A Necron Overlord is joined to a unit of Warriors. The warriors and Overlord are all killed, be it by shooting, CC, magic fairy dust, whatever.
Can the overlord make his Reanimation Protocol roll??
It states in the RP rules that the unit cant because all of the unit was destroyed. However, is the overlord counted as a separate unit for this purpose? I dont see anywhere in the rules for RP or EL that it states that he isn't counted as part of the unit for this purpose, other than he cant bring back the rest of the unit if he is the sole survivor. However, he hasnt survived either, so can he make his RP or EL roll? From the way I am reading them, he dies if the whole unit goes down with him, as per the RP rules.

This is currently being debated (more or less). Some of the more umm, prominent members say you still get EL, and would respawn (if passed) within 3" of where it "died". Others state that since the unit is gone and you must return in coherency of the unit, you would not.

This is another cool aspect of this game... I just discovered this site http://www.theruleslawyers.com/2011/11/on-appeal-necrons-ever-living-rule-and-resurrection-orbs/
This "Rules Lawyers" website argues 40k rules as one would before the supreme court. Kinda like the ultimate " 40k You Make Da Call" on dakka.

One of the more cogent responses to the court's decision applies to your question:
If you roll EL “just as you would” for RP, and the two rolls are indeed one and the same:
1) RP cannot occur if the only surviving model is a character. Ergo, neither can EL. What do you do with a Royal Court where they are all characters? By the RAW of “just as you would for,” a Royal Court can never make RP rolls.
2) EL stipulates that if the model with EL was killed while attached to a unit it must be reattached to that unit after it succeeds on its RP roll. If the unit it was attached to is dead, placing it in coherency with the dead unit is impossible. EL goes on to say that if placing the model is impossible, the model is destroyed. Ergo, if a character and unit are wiped out, the character can make the EL roll but, if successful, cannot be placed into coherency with the destroyed unit (which is disallowed the chance to use RP due to no survivors) and so the character is also destroyed.

Hmm, thanks for the link to the rules lawyer site.
There's some real food for thought here on EL v. RP
In general it 'seems' like ICs were intended to be able to stand up regardless (not accounting for sweeping which removes them from table flat out), but as they ARE stuck with RP for a frame they are susceptible to the pitfalls so far mentioned.
The information about the full court and EL is hilarious by the way.

welcome to the new necron codex, where this is just one of at least 2 dozen issues.
Long story short, by raw it simply doesn't function (wee self-contradicting rulesets), but RAI you need to take up with your opponent as there simply is not enough information to go on...
