I'm looking for a place that sells Roman Legion minis for the era of Caesar through Octavian. I have a group of friends wanting to play out the Roman Civil wars. Also any one know of any good rule sets? We were planning to buy a WHAB rule set.

I think Warhammer Ancient Battles uses 28mm we're also looking at DBA which I believe is 10 mm or smaller i may be mistaken but I know they use small figures.

You might want to clarify that you're looking for Early Imperial, as opposed to Early Republic (i.e. pre-Marian).

Unfortunately I can't help you on the minis front. They're not really that hard to find, but I don't have any experience with the brands so I can't provide advice as to which are better. On the rules front, I can provide the following suggestions -

My local store owner loves WAB, and swears that one of these days he's going to start playing it again. He is extremely annoyed at the fact that he can't stock the rules in his store.
Field of Glory is popular in a lot of circles, but there are also a lot of people who seem to strongly dislike it. I've seen claims that you can often tell who's going to win the battle once the army setups are complete.
Impetus is apparently reasonably popular. There's a free version of the game called Basic Impetus that's available on the official website. You can download it along with a number of simple preset armies for play. If you like it, then you can move up to regular Impetus.
Rick Priestly, of GW fame, recently (at a game convention in the UK last April, iirc) released a new set of Ancients rules called "Hail Caesar". It's very similar to his age of musketry game, "Black Powder", but for obvious reasons the emphasis is on hand to hand instead of shooting. I've heard generally good things about it. He posted some developer notes on the Warlord Games website that describe enough of the details of the game that you should be able to get a general idea of the game mechanics.

From my research Marian is the Era I'm looking for being that the Imperial age wasn't until after Octavian defeated Anthony, and i do believe that is as far as were playing. Polybian Romans were the Republic Era leading up to the "age of Roman kings" as I like to call it. I have a decent amount of figures for DBA from the Polybian age but their Carthaginians (squee War elephants lol) I bought from a game store that closed down. It was the only game store in the area that would stock Historical minis and I cant remember the name of the company that produced the models for the life of me.

I will have to check out "Hail Caesar" I enjoyed "Black Powder" quite a bit thank you for the recommendation.

I believe Renegade minatures do a range of metal figures in 28mm.

If you are beginning, i would suggest have a look at the Plastic Soldier Review and pick up a few boxes of relatively cheap figures. Base them up and see if you like the way the games play out.

if not

In the past we have used Pendraken 10mm figures , en masse per base. The packs of 30 foot or ten cavalry are cheaper then one GW metal figure and when fully painted have a great tabletop presence
