Can a royal court be played as one unit, with the overlord not part of the court, or has the overlord to be in the court counting as upgrade character till he is alone ?

There is nothing stating it is a retinue, nothing at all, so it isnt one.

The Overlord can go where he pleases, just about - he doesnt have to deploy and stay with the royal court

The court is a completely separate unit from the Overlord. You have no requirement to attach the Overlord to the court.
