So, the way Ive played it and the way most people I know play it is that virtues are part of the points pool for magic items. However after I reread it its very vauge. It reads may take one virtue and a mix o f magic items worth up to 50/100. Now i do read that as the virtue uses the points pool. Is that the correct way? I dont want to have been cheating myself out of points is why im asking.

I believe that it is out of the magic item limit. At least that is it has always been played locally.

I don't have Brets but Big Names for Ogres are taken from their magic item pool. Gifts of Chaos and magic items come from the same total for Beastmen.

WoC mix and match theirs. So you can get 50 Gifts and 100 magic items. Lizardmen Slann can get 150 Disciplines 100 magic items and a magic banner, cuz they're big bad Buddha frogs.

So there's examples of both ways. Brets is such an old book is there anything in the FAQ? If that is an exact, word-for-word quote, I would say they are separate pools. (EDIT: though I don't know the list at all, just to make clear.)

They can have a magic banner on top of that too.

OT: The bret book in it's current form just gives their chars an additional class of item to put into the upgrade total.

So i apprently have an older first printing where the rules are vauge. In the newer printing its quite clear that its taken out of your characters point pool. Somtimes i forget the book came out almost 10 years ago. Which is weird that i got a first printing since i bought my book 6 months ago.

Yeah, which is why i couldnt find an answer. I googled it and the answer was the reprints fixed it, so naturally i assumed i had a second printing. Nope.

You have to pay for your virtues from your magic gear allowance

The wording is kinda vague, but if you parse it carefully the meaning becomes clear. Virtues do come out of magic item allowance.
