My brother has put a lot of time, money and effort in his chaos and imperial army...
He is adamant at not using them both in the same game...
I told him the imperial can be traitor legion but he doesn't believe me....
please tell me if you can confirm my beliefs.....

Well, if you look in the current Chaos Space Marine Codex, you won't see any Imperial Guard or equivalent models.

If you look in the current Imperial Guard codex, you won't find any Chaos Space Marines.

If you look at Imperial Armor 5, 6, and 7, you will find 3 separate army lists that allow you to mix Chaos Space Marines with Renegade Imperial Guardsmen.

Do you mean Imperial Guard or Loyal Space Marines? You can have normally loyalist space marines played as chaos marines. For example, Dark Angel marines played with a chaos codex.

Yes it is. Also you might be using the wrong term, which is confusing him. Instead of traitor legion, call them traitor guard.
