Sportswear company Adidas has sued THQ for breach of contract, according to The Oregonian. The lawsuit was filed last Wednesday in the Multnomah County Circuit Court. The company claims that THQ signed an agreement to create a "miCoach" digital exercise software product, which it was to deliver in January of this year. THQ failed to deliver said software and Adidas claims this breach of the agreement has caused more than $10 million in damages.
The software was supposed to give Adidas customers a digital exercise measurement tool like what Nike's Nike+ currently offers. The agreement was signed in December of 2010. THQ has suffered a number of setbacks this year including plummeting profits thanks to the uDraw peripheral for Xbox 360 and PS3. The company has been forced to restructure its Play division and lay off hundreds of employees.
No doubt Adidas is simply interested in the software it was promised and not a series of excuses.
THQ has declined comment on the lawsuit. The news comes from Kevin Dent, head of the IGDA Mobile SIG and harbinger of doom for all bad news related to THQ as of late (Dent has made a number of pronouncements and predictions about THQ that have proven to be true).

Well it kind of serves them right. THQ agreed to have it by done by January, it is now March. They breached their contract.
That being said suing for $10 in damages is a bit stupid.

They go for 50ish pence here, with packs of 4 chunky ones for £1 - £1.50.
