Are 40k Tournaments comped in the same way Fantasy ones are? If not, should they be??

Generally No.

There is an argument that spam-crap should possibly be comped out, more through boredom with it than anything else!

This is what I'd honestly want to see comped out of tournies. Spam lists are boring after 2 turns, let alone having to possibly face 3-4 'clone' armies in the same event!

Overall 40k has a helluva lot fewer imbalance issues than Fantasy. In Fantasy problems arise from specific magic item combos and/or spells within certain armies that really do need to be comped out otherwise you wind up with instant win-button syndrome. (ie: the Power Stone was typically banned before it got faq'd because against a large number of armies, it gave anyone with access to death magic the ability to turn 1 wipe-out Lizardmen, TK's, VC's, Ogres or Dwarfs)
Sure 40k has it's bad match-ups, but overall if you build a TAC list, you've got a reasonable chance at winning provided things like terrain & the mission objective aren't insanely one-sided.

The biggest issue that I personally feel needs to be comped right now is to not allow GK players to use Warp Quake before their opponent has had their first turn. It at least stops hienous abuses and possible turn 1 wipe-outs vs specific armies. (as a Daemon player, even a single 10 man squad can easily make the game nearly impossible to even draw)

Pretty much every 40k tournament over here in Sweden is comped. While the comp system works about as well as 40k without comp, it just (IMO) trades one set of spammed units for another.

Over here in the US there is very little comp that I have seen.

Special Character arn't prohibited usually. Every so often they are but its definitly uncommon.

Most "comps" are in the form of rule changes and interpertations.

Comping through mission and / or time is also quite common, if sometimes unintentional.

For example - mandating 5 objectives on the D3+2 objectives heavily favours non-elite armies with 6+ scoring units, or scoring units with large squad sizes able to hold multiple objectives at once.

Mandating 3 favours more elite armies

It is why GW made it random.

Another way to comp what armies you see is through not allowing enough time - people are less likely to bring horde armies to a game with a time limit too short for the number of points allowed. Also the balance of missions cna be important - spam crap has a big advantage in everything but kill points, so if you run 1 of 5 missions as kill points you end up helping spam crap even more than usual.

The best way to help comp out spam crap is by increasing the number of kill point missions, or introduce limited comp around filling slots with the same units.
