So i got the old model in a bits purchase and i think he is really cool looking. The problem is that i have seen a lot of complaining when peopl euse it as ghaz because the older models are smaller so there are LOS issues. For example the old model is not much (if any) bigger than a modern Nob. so what should i do? should i base him higher to meet the hight of the current ghaz or should i use him as something else in my army like a Nob or even turn him into a monument/statue and use him as an objective marker or peice of terrain? any thoughts? I know it is "Legal" to run him as ghaz but really dont mind changing it over to limit the whinny kids from givin me 'tude.

I would base him as such that he is the same height as the current model if people are pitching a fit about it. Personally I wouldn't care if I came up against it as whining about TLOS takes the fun out of the game.

While I love the old style Ghazhkull, he's simply not the modern version of the Prophet of the Waaagh!. The old Ghaz doesn't have a power klaw, nor is he wearing mega-armor. If you're using him (as a model), I don't think you should be using Ghaz's rules. Just write him up as a normal Ork Warboss, or even come up with some 'kustom' rules for him in your group.
I can see why people might have problems. Not only is he much smaller; he's not even equipped properly. Think of it this way: using Marneus Calgar in Power armor to represent Marneus Calgar in Terminator Armor. Both models are current models, with current rules, but it's not really appropriate to represent one using the other. Not only is the size/LOS/base size wrong, it's actually the wrong equipment.
