My question in regards to the new allies rule is if I was to take Ork allies into a Tyranid army (as an example) would I be able to, instead of use the ork models, design and convert my own Tryranids which would then use the same rules as the Ork allies would?
The army would, for all intents and purposes, play out the same. Only difference being instead of having a few lost looking Orks in amongst a sea of Nids it would be a complete Nid army with a few unique bio-forms (remembering of course that those models would use Ork rules).
I was actually considering taking Tau allies into my SM chapter but wanted to change the fluff of my allies so that they were still just space marines.

AFAWK Nids can't take allies. I just don't want to see a bunch of royal blue painted Ultramarines with their owner saying "these are Grey Hunters".
I don't like Allies one bit and I won't until I read the rules for sure. However if my opponent makes the effort to convert and paint his allies so they fit into his main army, I'll probably frown upon them less.

It seems there's still a little confusion. Let me use another example.
Once again with Orks but say instead of fielding standard SM allies could you convert a group of Orks to appear to have looted SM equipment (shoulder pads, weapons, armour) and have them count as and function as a Tactical Squad?

I know there are lots of people out there in DakkaDakka land that love being a little too creative. I can just see this as a confusing way to field an army. If they are orks looting things, they are orks. Period.

Make it cool, make it looks nice.
Make it CLEAR to your opponents what every unit is (even print some charts with pictures and description).
If you do things like that in a good way, positively thinking in the hobby, and your opponent dont accept it, he dont deserve to play with you...
GW state as a rule that no one can use models from other companies in their game, but the far majority of comunity call it bs...

I make the same question, my marines are Space Wolves, but they are all modeled keeping in mind that someday i can choose to field them as regular space marines, or blood angels, or wheatever... (ok, i dont like the ideia of fielding them as grey knights...)

Personally I'd have no problem playing against an ork who counts-as a marine ally. BUT it needs to be absolutely obvious to opponents what each custom model is representing - e.g. the above ork who counts-as a marine is fairly obviously more marine than ork, although I'd prefer him to carry a bolter rather than just a standard ork gun with an eagle stuck on
For your specific example though, Nids can't take allies, regardless of what they look like or count-as :(

As long as the models are clearly visible as being a different army and kitted out correctly I'd say go for it.

No. It's a flat no and it has nothing to do with the "counts as" rule. Tyranids are not allowed allies on the allies matrix, so there is no legal way to field units using ork rules with a tyranid army.
If you were using the "counts as" rule, you could have ork models converted as genestealers, nobs using warrior wargear grots counting as rippers or something to that effect. They would have to use rules from the tyranid codex.
Conversely, as Tau and space marines CAN be allies you could do some conversions to show your fire warriors as sm scouts or stealth squads as PA marines. The only reason your example doesn't work is because tyranids are not allowed allies.
