In a 6ed, game had an opponent claim a night fight cover vs Imhotekh's Lord of the Storm power during first turn (I went first so no skimmer jinking or anything like that). Imhotekh was >24" away from all his units. Only one of his vehicles was struck as a result of the D6 roll- and he claimed a shrouded cover save because Imhotekh was so far away (he was actually over 36" away) but opponent "compromised" by taking the shrouded cover save due to the distance during night fight. My position was that no LOS or range is stipulated in the Lord of the Storm rules so he should not be able to claim ANY cover. Your thougths and 6ed references are appreciated.

He gets a cover save if applicable. That means no cover saves based on LoS (the attack doesn't have a vector). Any cover saves from a more generic source, such as being in area terrain or Shrouded, would still apply as the attack does not have Ignores Cover.

"'players must agree how they are going to select their armies, and if any restrictions apply to the number and type of models they can use."
This is an actual rule in the actual rulebook. Quit whining about how you can imagine someone's army touching you in a bad place and play by the actual rules.

Let me clarify- his vehicle was in the open (no hard cover or area terrain blocking) and had not moved...

Doesn't matter. Shrouded and Stealth give cover saves to things outside of actual cover.

So by that reasoning, anything over 36" away from Imhotekh can't be hit by the power (due to night fight), yet the power itself says all units on the battlefield are hit on a D6 roll of a 6... Seems contradictory...

Actually, I change my answer. The attack does not come from anywhere, so you couldn't possibly measure the range to see what Night Fighting provided.
If a unit had Shrouded or Stealth innately, outside of what was provided by Night Fighting, then those rules would still provide a cover save, but Night Fighting alone can't.
It's Imotekh's rule, but he isn't the one shooting. Nothing is actually shooting.

Yeah, that was my counter-point to him... Vehicle had no other claim to any type of cover other than the night fight range to Imhotekh himself...

Some people argue that they can use Cryptek with Chronometron to re-roll the rolls for Lightning with Imhotek.
If one happens to be in that camp, then Imhotek is the source of Lightning and all Night Fighting rules would apply to them too.

Not sure I agree with your premise although tbh that situation hasn't come up for me... It is certainly Imhotekh's power so I suppose a cryptek w/ chron could provide re-roll if in same unit, but that doesn't necessarily define Imhotekh as the firing position of the power... The special rules of the power clearly deviate from both LOS and range requirements of shooting...
