Which codex fits te new rules set least well? I'm not talking about which has the least chance of winning, but which doesn't meet the elements we find in the new edition?

'nids can't take allies or use fortifications, but are otherwise okay.

Nids can use fortifications, it's just they cannot MAN fortifications, they shoot at BS2 without someone using them.

Tau is still pretty outdated, even with the buffs to moving and shooting etc.

Any codex with the lack of flyers is going to be at a pretty big disadvantage. Either you have to pay a "tax" by taking an allied HQ and Troop (which aren't flyers themselves) just to take one of their flyers or you're going to have to take a 100pt.+ fortification.

If you don't think you need flying defence, then you're missing 6th Ed.

Well Chaos Daemons have no need for fortifications as the majority of the codex lacks a BS value and is close combat oriented. They have neither flyers nor a reliable way to deal with flyers. As well mostly devoid of range attacks to take advantage of over watch, snap fire, or the new rapid fire rules.
