I recently purchased the warhammer forge nurgle ogres but as I'm not running them in any actual lists was thinking of using them as beasts of nurgle in a 40k army, beasts of nurgle are the only thing that i can fathom that they even remotely could resemble, would anyone have a problem with this being used against them?

Well seeing as beasts of nurgle are often varied and sometimes so different that you can never be sure what it is.

I wouldn't feel off facing one.

No problems here....

but then again ive played 3000pt battles were the majority of the models are lego men, various other toys and paper cut out bases.

Don't get me started on the lolly jar monoliths.

So when it comes to could as, i'm pretty easy. So long as i can remember what it is.... and if i can't; usually i get them to write it on a bit of paper next to them lol.

So yeah, but i don't think anyone will have a problem with this.

No! I won't let you use cool and fitting models to represent units in your army!

Go for it They're appropriately sized for a counts-as, and while I don't know the Beast stats off the top of my head, I'm sure they're not too far off.
