On the one hand you have stories like this, where the guy reproduced their logo stroke-for-stroke, yet they are as polite as can be, and even willing to offset the costs of him redesigning the cover, and then you have stories like the recent one about Monster, who are suing the balls off a fish company because their logo has an M in it. It just goes to show how off-the-wall crazy some people are.

this isn't just polite. JD is trying to avoid pissing people off, and in the end, it's trying to protect its own brand. It's more effective to nudge people away than come screaming at them with a chainsaw to the face. It makes more sense to work with someone else to change their brand and use your own money to help the process, than it does to take them to court and pay twice as much or more in legal fees for what may in the end be the same result anyway.
It's a damn bloody shame that out-of-court settlements can't be used as precedent in the court system.

Yeh. The kindness of it may be down to Jack Daniels not wanting to go through a court case where there is a possibility of the US parody laws being brought up. Kind of: this might cost us a lot of money so lets play the nice card first. No doubt if you turn down the nice card you get the big growling corporate bastard card.

And of course if the nice card goes public you get a friendly advert and a lawyer for the price of a lawyer. Plus it's better to play the nasty card when you've been publicly snubbed (which doesn't appear to have happened here).
This is a very clever move on JD's part IMO.
