Ok so here is the situation...

Rhino pulls into a Building with LOS blocked to a squad of ork boyz that are 5 inches awayon the left side of the vehicle. However the Rhino can only see models 7 inches away. Inside the Vehicle is a squad with 2 flamers. Opponent declares the charge. I say I am over-watching and the kill 3 boyz where should the models be removed from? The models that are closest to the vehicle or the models that can be seen.

My opponent said that I had till kill the ones that were 7 inches because I couldn't see the ones 5 inches away. He the assaults my vehicle because he rolls a 5 to charge it... If I remove the models that are closest he fails the assault. In turn he was able to bust them out of the rhino which caused a pining check which I failed and he was able to gun down the squad.

An Overwatch attack is resolved like a normal shooting attack (albeit one resolved in the enemy's Assault phase) and uses all the normal rules for range, line ofsight, cover saves and so on.

You can't kill models you can't see. Unfortunate, but that was correct.

OUT OF SIGHT: If no models in the firing unit can see a particular model, then Wounds cannot be allocated to it, and must be instead allocated to the nearest visible model in the target unit. If there are no visible models in the target unit, all remaining Wounds in the pool are lost and the shooting attack ends.


He was correct.

Then wouldn't he need to measure from the unit that has LOS to the vehicle to make the assault since the ones a 5 inches could not see the vehicle.

Nope. The rules just say that you can only declare a charge to a unit you can see. It doesn't say to measure from the models that can see.
