Subject: vindicare assassin and/or precision shots with LOS

hello dakka, im wondering about an occurrence that came up over a move involving a Vindicare assassin able to shoot and allocate wounds to a model out of line of sight. My brother (the other player) plays GKs and was usuing his Vidicare Assassin to fire at my unit of Immortals with my Overlord attached and use the Vindis special rule that allowed the controlling player to allocate the Wounds caused. Now, the unit of Immortals were placed behind a Monolith with the Vindi on the opposite side and just a bit to the left. From the Vindi LoS, he could only see one model from the Unit that being an Immortal. He used his special rule to allocate the wound to my Overlord. Here is the rule in the Codex p. 53:
Deadshot: wounds caused by a Vidicare's shooting attacks are always allocated by the Vindicare's controlling player.
Since this special rule works pretty much like an upgraded version of precision shots, my question goes towards that too. Do these two rules circumvent the rule you cant allocatte wounds out of line of sight?

Q: Do Precision Shots have to be allocated against models in the
character’s line of sight? (p63)
A: Yes.

Greebo had spent an irritating two minutes in that box. Technically, a cat locked in a box may be alive or it may be dead. You never know until you look. In fact, the mere act of opening the box will determine the state of the cat, although in this case there were three determinate states the cat could be in: these being Alive, Dead, and Bloody Furious.

While the precision shots are not able to be allocated to models out of los, the vindicare assassin is not using the precision shot USR to allocate wounds but rather a similar rule. One could argue that the vindicare assassin could indeed allocate to your overlord, as there isnt anything stopping him from doing so. But the moment he allocated the wound, it would be lost, as i believe theres a bit in the BRB that states you cannot wound models out of LOS.
That would be my thought process.
Basically; yes he can.

Page 16, out of sight, means there is no point allocating out of sight even if this is possible.

Look at it sequentially; fire at unit, allocate wound, LoS!, save for wound, special rules(FnP, LoS![in some cases]), casualty removal/roster wound allocation.
In this case, yes, your friend has the right to allocate the thus-un-rolled-save wound to any model he wishes. So he allocates it. If there are no models in the firing unit(i.e. the Vindicare) that can see the target model(i.e. the Overlord), then the wound must be allocated to the nearest visible target. RAW.
