This is not a RAW question. This is a HYWPI (How You Would Play It) question.
There are a number of weapons/abilities that can affect units that are not within LoS. From a strict RAW point of view, we know that wounds cannot actually be allocated. So my question is "Assuming you allow the weapons to allocate to models that are out of sight, how do you determine the cover save?"
For some things, this is a no-brainer, such as barrage (which assumes the shot is coming from the centre hole, or Impaler Cannons which ignore cover saves if the model is not in/touching area terrain).
For example, Eldar Swooping Hawks have a grenade packs which are dropped when the unit deep strikes. Assuming the unit hit is behind (from the Eldar player's POV) an ADL, and the Swooping Hawks DS out of sight from the unit hit, how do you determine the cover save (if any)?
For those curious, here is an incomplete list of things that are affected:
Blast weapons scattering
Template weapons
Impaler cannons
Swooping Hawk Grenade Packs
Astral Aim

I'd give a blanket 4+ cover save to the target or "victim" assuming the attack doesn't negate cover in any way (ie - barrage, no cover, Impaler cannons, no "free" cover).

I asked this in a poll back in September (you were the first to answer me), here are my findings:
What cover save does a model out of Line of Sight have?
Static 3+ 0% [ 0 ]
Static 4+ 4% [ 1 ]
Static 5+ 0% [ 0 ]
Static 6+ 0% [ 0 ]
Whatever is hiding them (fortifications are 3+ ruins 4+ forest 5+ etc). 83% [ 19 ]
Something else (Explain below) 13% [ 3 ]

we always play if it has a chance to go around a corner, i.e. scattering shots, it hits anything under the template. Per RAW rules regarding which side of a vehicle is hit by a scattered shot (the one closest to the firing unit) is how we determine the cover.
Like if i have trukks hiding behind a BW you cant see them, but if you scatter on them i get a 4+ (5+ for model obstruction, +1 for less than 25% of the vehicle is visible...i.e. you cant see it).
Nothing says that +1 to cover is ONLY ruins, the example just happens to use ruins. I know it does say the FRONT of the vehicle, but we see that as silly it should be the body obstructed not the face. Otherwise i can just hide my Ram behind a building and, per RAW, get a 3+ coversave lol
If i ever came across someone that tried to bring up the out of sight issue for scattering shots i think i would either try to make him/her see why it makes no sense to not allow it, or just pack up and leave cuz theyre a stupid WAAC player that siphons all the fun by doing loop-te-loops through the RAW rules.
Some rules, after all, have to be interpreted as how it would happen IRL, not RAW, else it makes 0 sense whatsoever.
