then in its unit dis-embarking part says use the deepstrike rules to disembark which would dis-allow assaulting?

That's only if they disembark while it is zooming. You will usually disembark (and assault) while hovering, and then you do it just like any assaultvehicle, except you count from the base under the flyer, not the hull.
