There isn't any, really. GW and FW both have said absolutely nothing about this since about 2007 when Warwick Kinrade wrote something in one of the IA: Apocalypse books IIRC, despite many people trying to blow smoke about how FW would be as legal as codex entries when 6th was released, but that turned out to be bs: 6th edition rulebook doesn't say anything about FW, GW never made any big announcement promoting their use or trying to push sales for it, etc.
Some people argue that you can simply because GW owns FW so everything they make is "obviously" official for all games. FW used to be considered an "optional" thing, FW themselves even said so for quite a while, basically saying FW was every bit as "official" as Cities of Death, Apocalypse, etc., and encouraged people who want to use FW models to warn people beforehand, and their use in tournaments has always been limited to the whim of the TO. Personally I don't see how that's really changed much in the past few years. People will argue with you about "40k Approved" stamps and gak, but in the end it doesn't really matter. If you play in tournaments and the TO allows FW you have to play against it. If you play pick-up games and you don't want to play against FW models then you don't have to, no one's going to "force" you to play a game of 40k and if they do they know where to get the feth off.
