Subject: Does Imotekh's night fighting rule still apply if night fighting isn't a rule in the game type?

Does Imotekh's night ability still apply if Night Fighting isn't a special rule in the game type?
The texts say "If your army includes Imotekh the Stormlord, the night fighting rules automatically apply turn 1."
At a recent tournament, the rules of the game type didn't include night fighting. So my opponent tried to tell me that Imotekh's night fighting ability couldn't be used. The logic being that since night fighting wasn't a rule of the battle, it couldn't apply.
I convinced him that Imotekh made the rule apply regardless because it was his ability, but looking back his logic actually seems pretty sound so I just want to make sure I know how it works.
I suppose my specific question is, if Night Fighting isn't a rule of the game type, does Imotekh's ability still make it apply? If not, could you still use the Solar Pulses in a game type where Night Fighting isn't a rule?

If the game has Night Fighting it just means you arn't rolling randomly to determine if it happens.
Imotekh automatically makes it Nightfighting, overriding any lack of Night Fight.
It doesn't say there can't be Night Fighting, just that it isn't going to happen randomly.

If the game can't have a night, than Imotekh can't make it night.
But all missions have Night Fighting as far as I know.
Pretty lame of the TO to exclude that.

This isn't quite true, Grey Templar got it. The wording says that the Night Fighting rules automatically apply. It doesn't, for example, say "any rolls for Night Fighting automatically succeed".

True, but that is different if Night Fighting doesn't excist by your TO's made up rules.
This discussion seems kind of pointless.
I checked the six Missions and they ALL have Night Fighting.
So what game-type are we talking about?

Your TO would have to explicitly say Imotekh can't make it Night Fighting for his rules to not apply, which is unfair as Imotekh pays to make it Night Fighting.

Yeah the TO would have been pretty mean to not let Night fight go on.
It would be saying every special rule not listed is not part of the game.

I would also like to point out that if your opponents assumption was correct then in this instance the "Solar Pulse" wargear item would have never worked in that game either. Does that not sound wrong to you?
