So, I did an online trade (via another site, posting here because I don't want to start a fuss over there just yet), with someone who has a good trader rating. They sent me most of what they owed, with the promise that an additional couple minis would come via separate shipment because he did a snafu with his model counting. It was a very fair deal on both sides basically retail for retail, so its not like hes losing money on this. Its been about 3 weeks and I still haven't received the last few minis (which are worth about 30 bucks total), and he hasn't responded to my messages for the past week/week and a half. I know he read them mind you, given the setup of the sites PM system...

Now, I have the guys name, home address, and paypal email address... surely between all of these things there must be a way to get whats owed to me by (hopefully) legal channels, or at least scare him straight again. I'm giving him more or less one last chance to send me a message and explain himself, but I'm not really sure what the best course of action after the "grace period" expires is. Your thoughts?

I have had the same issue now. Where did you do your trade? I just felt bad about it, and got over it. There is not much you can do.

In my experience I was lied to about a tactical squad and really just got some mismatched pieces of Dark Vengance from a guy who thought that they were worth as much two grey knight strike squads that were well painted.

I was an idiot and didn't think it through too much and now feel bad. It could have been much better.

Police? Site admins, ask for a postage receipt to make sure it wasn't a problem on the mail side of things.

If all else fails order a bazillion pizzas to his house from every delivery place in the city in which he lives so he can never get pizza delivered again.

Was it a payment to him or a trade?

Assuming it was a payment as it is payment as you have paypal details...From a debt collection POV:

1) Send him an email saying "Hi, I haven't got this yet. Can you let me know whats going on?" Give him a chance to explain.

2) If no reply to that, 5 days later send him another email saying "Hi, you havent come back to me and you haven't sent me the minis yet. Please sort this out immediately".

3) If still no reply then send an email saying "I have not received a reply or all of the items I have paid for. If I do not have a reply within 48 hours I will raise a dispute on paypal".

Then follow through.

If it was a trade rather than payment then replace the threat of paypal dispute with an ominous but vague threat of "Further action".

That's not really ripped off. Getting nothing for something is getting ripped off. Getting slightly less than you counted on is annoying and poor trading on his part.

Poor/bad trade:
- Follow-up for a couple weeks to try to get it sorted
- Initiate partial paypal dispute for disputed amount if cash transaction.
- Negative feedback on the site in question. (Transaction report here, Bad Trader report on BT, etc.)

Ripped Off:
- Initiate paypal dispute for disputed amount if cash transaction.
- Negative feedback on the site in question. (Transaction report here, Bad Trader report on BT, etc.)
- File Police Report / Mail Fraud, etc.

Honestly? My response would depend on whether or not the guy lived somewhere cool. I have a really funny habit of showing up in person (but only if there's some cool tourist stuff in the same city to make the trip worth it). And yes, I have shown up in person before (never for 40k, though- I've had very good luck with that)

Only done it twice; one gave me my product, the other a refund. I'm very polite in person (Canadian, eh?).

Why punish the pizza places? Driver goes out on a run which doesn't get him a tip, the shop has lost the cost of the pie and the delivery. Over $30 of figures you're gonna screw a bunch of non-related local businesses?

Nice.

Nice.

You could just do it to Papa Johns, they have terrible Pizza anyway and they need to go away.

But seriously, Ask the guy whats up. check again 5 days later if he did not respond. Call the local police in his area and forward them all of the correspondence and let them pay him a visit.

Well as it turns out, the owner of my FLGS explained to me how to make it a mail fraud issue, and its rather simple at that. So thats my plan of action now (it helps that I have a lawyer for a dad, and also pro bono private investigation services which might be able to get his REAL name from Paypal via his email and their financial records. ;D
