Ok so the guy leaves to go smoke during a game. I am sitting at the end of the table by the middle of the board. The dice he was using are a ways a away from me. A pile of his spare dice are right here at the end of table. There are some D20 all the way to D4s and a bunch of d6s.
I set a bunch dice to 6s. I go to set some dice to 1s. Well there are some dice w/ 2 sets of 6 on each. I check the dice he is using they are all fine. I look back thru the spare dice and it is only 2 fulls sets of D&D that have no 1s. D4s all the way to D20s. They have the highest number twice instead of any 1s.
What do you do? He isn't using them. Do you make an issue of it?

Well for starters don't dig through peoples stuff
but naa if he isn't using them there isn't really a problem. but if you notice that he is using them then you should feel free to call him out

If he isn't using them I would keep an eye on what dice he rolls. Otherwise it is probably not worth it.

Hard call. I'd probably excuse myself from the game at that point. I wouldn't feel comfortable, even if he isn't cheating at the game at hand.
On the other side... you were going through his dice?

Yeah while he was smoking I was just bored screwing around with the space dice at the end of the table.

If you see him using them, ever, call him on it. They could just be novelty dice a buddy gave him because he rolls so poorly. Especially if they're a matched set.

I don't know why people seem to be thinking looking at the dice was odd. They are just dice, unless you have something to hide, which this guy did. I would even be happy to let my opponent use my dice for all of their rolling etc.
Now If he went back and started fiddling with the guys army case, thats not cool.

That someone has rigged dice that scares me. Why have them unless at some point you plan on using them?
Edit:
Was he hidding them tho? They are out on the table. If your planing on using them keep them in bag or on you but people can be dumb tho.

I had thought they were in a bag or something, reading others replies. Going back to the OP, they were on the table, so fair game.

How was the battle going for him at that point?
Seems to me, if he has them, but isn't making use of them, they're something he carries around and uses if the game's going poorly for him. If he doesn't need the added benefit of the cheat dice, he doesn't use them.
I wouldn't have made an issue of it during the game, unless he uses them. There's no point potentially ruining a game because of something that, at present, isn't affecting the game.

I think the issue is that the dice were his property, Con. Some people are miffed whenever other people handle their stuff without asking. I wouldn't get bent out of shape about it, because I have a bad habit of fiddling with stuff too, and have frequently been the perpetrator of this particular breach of etiquette myself. Ironically, it totally irks me when people do it to my stuff. I would be totally fine with letting them handle it, I just want them to ask first.
That being said, unless the guy has given me some other reason to distrust him, I would just be straight about it and ask him what the story behind the dice is. My default assumption would be that there is some sort of humorous or otherwise acceptable anecdote behind their inclusion in his dice pile.

Naw the dice were dumped out on the end of the table.
I didn't say anything and just watched hoping to catch him. He never went near them except when he packed up.
The game was a forgone conclusion tho no way he could beat me.
I do dislike smoking btw. Unreasonably so. He is lucky I didn't start hiding his guards men in terrain but I have a tough enough time getting games anyhow.

Well, because it is odd for MANY reasons when it comes to gamers. Hell, as someone that goes to the casino a lot, it's a big no-no to touch someone's "lucky" this or that, or to touch the dice if someone else is rolling, or to well do anything like that.
As a gamer, NO one touched anyone's dice. For one it's not yours, so no touchy. For two, some people are just in the mind set that messing with their dice is bad luck. You may not think so, but then I am sure there is something you don't want other people to do, they might feel is fine. If someone wants to check my die, then I let them, but I wont let them use it to make rolls for their minis. They can test roll it, look at it, pet it, whatever, ONCE they ASK, and that's it. I don't need someone using up all the "luck" even if it's bad luck. I had this talk with a CCG player once, who only played card games, and they did not get it either. But old school gamers who play D&D, or other table top games a lot (Cyberpunk, Shadow Run, Pathfinder, Vampire, ect) have set patterns. They leave their dice set one way, or wont use new dice, or have to keep their dice apart from their other dice, or something are very dead set in those ways.
I would never dream of rolling someone else's dice, I would never touch them without asking first, and I would think no one would mess with my things without asking first, and even more so when I was not there to make sure things didn't vanish.
As for his "loaded" dice, they were D20s, D10s and D8s and D4s, that he would not need to use in 40K, so it's just the matching set of D6s, which most likely didn't match what he was using. And I am sure there is a reason he had them, from they were a gag gift, one of the "2s" was marked as a one so he didn't really "roll a 1, but he did botch" or he cheats at D&D. And cheating is bad in all forms, but so is digging into people's stuff. Hell I hate it when someone comes to my house and start poking around my stuff looking for something, since they can ask. OP was already beating him, so he was not cheating that game, but the best case is to say sorry for getting all touchy with his things, and then ask about it, and keep it in mind if you need to bring it up to someone else, and hope he doesn't say things went missing and someone admitted to pawing at his things when he was not at the table.
