Ok, yesterday I had a game where this situation popped up:
Abaddon and 10 CSMs charged a unit of 5 TH/SS Terminators. The roll was successful, but only 6 CSMs were able to get in base contact (or within 2" from a model in contact) with the enemy. Abaddon and 4 other CSMs were too far away to actually strike after the charge move (but BEFORE any pile-in move).
Then, the fight sub-phase begins.
The model with the highest Initiative is Abaddon, so he has to pile-in and attack first. However he's at about 4" from the nearest model in base contact with the enemy, so he shouldn't be able to attack. It's also the very first Initiative step of the very first round of combat.
Is Abaddon allowed to pile-in?
One opinion was that the highest initiative that counts is the highest one of all the models that are directly engaged in combat and can attack, so the highest model had I5 (due to MoS), which is lower than Abaddon's (I6), hence Abaddon doesn't pile-in or attack this turn.
The other one thought that you have to consider the Initiative of all the models LOCKED in combat, which means all the models of all the units that are fighting in that combat.
