If I am running a double FOC army, does my hq with the highest Ld still have to be my Warlord? The warlord rules say that he can be chosen from either primary detachment, and I would prefer my Warlord with ld 9'to be my Warlord for his Warlord trait, instead of my ld 10 hq.

No choice in the matter sadly.
It's always a pain for my Guard force. I'd prefer the Commander to be in charge, not the Lord Commissar.

This. The rule is "highest Ld", and does not state "within the detachment you have chosen".

I do dislike the whole "highest leadership" clause. It basically force situations like Bob the Warpsmith taking command instead of Daemon Prince Murderall the Killinator. Why are princes Ld9 again

Because every daemon prince is basically ' the starscream', just waiting to happen.
Daemon's are less disciplined as a whole, it's one of their few drawbacks. (well, besides their expense, points-wise)

It would be much better if you could just choose.
I'd love to have a Meka Dread as my Warlord for my Ork Dread Mob (they're great with their warlord trait, rubbish without). Only way I can do it is to take no other HQ's :(

It's fine I was just trying to find a loophole to run Be'Lakor and Fateweaver without using Be'Lakor as a CSM allied HQ as I also wanted a Black Mace Daemon Prince. Looks like I found a way, it just used up 2 primary and 2 allied FOCs.
