So me and my friend were talking about the new Magnus model and were wondering if he would count as a demon for the purpose of prefered enemy demons and demonbane. He argued since he dose not have the daemon USR he is not a daemon. I argued that since he is still a daemon of tzeentch he should still count as a demon. So who is right here?

Ultramarine 6000 : Imperial Knights 1700 : Grey Knights 1000 : Ad mech 500 :Nids 4000 : Necrons 500 : Death watch 500

If he doesn't have the Daemon USR listed with his other rules, then he isn't a Daemon.

Really he should be, but hey, what are you gonna do?

He's a demon.

Under his "Special Rules" section, he has "Demon of Tzeentch".

^^This. GW has a lot of rules within rules. Magnus doesn't have "Daemon" on his datasheet, but if you look up "Daemon of Tzeentch" you will see that all "Daemon of ..." rules inherently grant the "Daemon" USR.
