What happens if 5 marines stand on the highest floor of a ruin and there is no room for any other model. Are they imun to getting attacked because i cannot place my attaking models on the same floor?

You just have to be within 1", so as long as you're not charging with Grots you can just stand on the lower level.

However, as you are supposed to measure base to base, if you're using GW ruins, each level is way beyond 1" from each other vertically, so your models wouldn't be within 1" of enemy models on a higher (or lower) level.

A melee monsters/vehicles can't do ANYTHING to infantry on ruins. Unless someone can prove me wrong

I have played on alot of scratch build ruins and many of them have the same problem.

So looking at the rules atm, they would really be imun against charges? Probably will need some clarification that the floor under the top floor can always attack it.
