Was playing an Eldar opponent who used a ton of warp spyders, he was arguing that warp spyders can move out of combat and still shoot... But they do not have fly, they have a special rule that gives them "fly" in the movement PHASE. But he says since the description of models can not move out of combat and shoot unless they have FLY is in the movement rules, he can then do it.

What is the general consensus on this?

A unit that Falls Back this turn cannot shoot unless it can FLY.

Its debatable. But I would say the restriction was listed in the Movement Phase rules where the Warp Spiders had the FLY rule.

I could see this going either way.

Falling back is something that happens in the movement phase. If the rule gives them FLY during the movement phase, then they would be covered since Fall Back does state that a unit that falls back can't shoot unless it has FLY.

I was under the impression that the restriction would be per phase, so in the movement phase he can move per restrictions, in the shooting phase you can shoot per restrictions.

start of shooting phase:
I moved out of combat last phase, can I shoot? Do I have the FLY word? No? I cannot shoot.

The Warp Spiders had the FLY keyword when they fell back, therefore the restriction on shooting never occurs.
