Not sure if this is a well thats an interesting qwerk of 8th or there is some precedent for it to be allowed:

Had a game last night where i charged my mate's truk full of burna boyz, naturally he rubs his hands for the ensuing overwatch at me and then i was like hang on... can they even shoot me....

Oppen topped rules are generally the same across dataslates and as far as i can see the answer is no, they can't actually do it!

In 7th units had explicit permission to fire overwatch if their vehicle was charged.

That doesn't exist in 8th.

The unit being charged is the vehicle, not the unit inside. Open topped just gives permission to shoot in the shooting phase in 8th.

Yea it seems so it really put a frown on his face!

but then on the flip side i made it into combat and the next turn the truk fellback... but nothing stopping the burna boyz inside firing even though the truk fellback

Exactly this. You're assaulting the trukk, not the Burnaz inside.

Yup, this. The Land Speeder Storm even expands on this in saying that the Land Speeder Storm can shoot after falling back, but the passagers can`t.

Actually not quite, the open topped rules specifically state that the unit inside can't shoot after falling back even if the vehicle can.

Actually not quite, that is used as an example of a restriction transferring from the vehicle to the passengers via the open topped rule. If the passengers had a special rule that let's them shoot while falling back they could still do so.
