Do the models inside suffer the -1 to hit for the Transport Moving?

I was firmly on the yes category at first, since Open Topped transfers modifiers to the Passengers.

but I became a little on the fence when I read that Heavy weapons only affect Models that move, and the Models inside the Transport are not moving.
So even if it transfer the modifier of -1 if you moved, it's irrelevant since they didn't move.

I'm really looking to argue this one way or another, since I don't really care about the which is right.
I just want a confirmation which is right.
(FAQ worthy?)

They addressed this with the Ork Battlewagon in the FAQs:

Q. The Ork Battlewagon’s Mobile Fortress ability says the
Battlewagon ‘ignores the penalty for moving and firing Heavy
weapons’. Its Open-topped ability says that ‘restrictions and
modifiers that apply to this model also apply to its passengers’.
Does that mean that a unit embarked also ignores the penalty
for firing Heavy weapons if the battlewagon has moved?
A. No.


I think it's pretty clear that models in moving Open Top transports count as moving for the purposes of shooting.

Still pretty amazing for Dark Eldar though. as Venoms move 16" and the passengers can still shoot.

I think it's pretty clear that models in moving Open Top transports count as moving for the purposes of shooting.

They really should have put something akin to this question in the General, but works for me.
