So with the new alternating deployment I have a question regarding units that can infiltrate, namely tau stealthsuits and ghostkeels.
The infiltrator rule says you can set this unit up anywhere not in the enemy deployment zone or within 12" of an enemy. However if you have first deployment can you set up such a unit anywhere? There are no enemy units to avoid so you could be any place not in your opponents deployment zone.
Or is the restriction retroactively placed on a unit and thus making it an illegal deployment?

The scouts rule says 9" from enemy deployment zone. I don't have Xenos 2, but I'd make sure it doesn't give a distance from the deployment zone.

I can't think of a model with such a rule, but if the rule doesn't state when it needs to be placed, you can place it early during the deployment

I looked up the rule, and the stealthsuit does deploy 12" from enemy models and not in the enemy deployment zone.
So it looks like yes, you could set early near the deployment zone when there are less models. But the enemy models only need to be 1" away from you, and I imagine if you're close enough you'd get lit up.

There is no restriction for the tau rule. It reads: unit can be set up anywhere on the battlefield that is not within your opponents deployment zone and is more than 12" from any enemy unit.

As I said tau stealthsuits and ghostkeels have this rule. And that is my interpretation as well that if placed early these units can end up within 12" but not when they were placed.

If you place this unit first, yes, wherever you like, within the restrictions in the unit's rules (not within enemy deployment zone for Stealth Suits as mentioned). As there are no other models placed yet you don't need to worry about the 'not within 12" of enemy units' clause... everywhere is more than 12".

I think if you deploy your unit first, it respected the 'not within 12" of an enemy unit'. When the enemy player deploys his unit within 12" of yours, your unit was already deploy - so it doesn't need to check again if it is within 12" of an enemy unit.
