The Index states that the SM Librarian in Termie armour can take a storm shield whereas the Codex doesn't. My Libby is equipped with a storm shield - is this still a legal model?

Per GW, the index delatasheets are still legal for existing models that are not represented in the newer codexes. So yes, you can still use your Libby w/ Storm Shield.

The datasheets in the new codexes overwrite the same datasheets in the index books. You can certainly use units with updated datasheets alongside units from the index that have yet to be updated. Once a unit has been covered in the codex though, we assume you’re using the latest version.
This line means anything covered in the codex overwrites the index entry, thus making the index entry entirely invalid. The only index entries you can use are the ones that have "yet to be updated."

Respectfully disagree. That same article says the following.
While the indexes are designed to cover a long history of miniatures, the codexes are designed to give you rules for the current Warhammer 40,000 range. There are a few options in the indexes for some Characters and vehicles that are no longer represented in the Citadel range – certain Dreadnought weapons that don’t come in the box, or some characters on bikes, for example.
The dreadnought example is the key point there. Why even say you can play with dreadnoughts with certain weapon load outs that don't come in the box if the dreadnought from the codex removed the index version?
Yes it's confusing, but I think it's perfectly legal in normal games as long as you pull all costs and upgrades from the same book, so you pay the lib price from the index and all costs come from index price point, no pulling index lib and then paying codex prices for its weapons and storm shield. However if you lose the shield you have to buy from the codex as now those are the most up to date rules for the lib model you have.

All that means is that there are index entries for them, not that you are permitted to use them once the codex comes out. They explicitly say you CAN'T use them once the codex comes out.

You also need permission from your opponent to play 'Legacy' units. While this shouldn't really matter in casual pickup games at your LGS, it something you should keep in mind for games above that. I've been trying to drum up discussion on it in this thread

There is nothing I have read that makes them "legacy" units or that require "opponents permission" to use them.
The confusion is coming from where if a unit exists in the Index, and Codex. Once the Codex is out you must use the Codex.
However if there are options for a model in the Index that do not exists in the Codex. You simply use the Index datasheet, and the Codex points.

It would certainly seem at first pass that you cannot use him, but their FAQ addresses this poorly to suggest you can.
In reality this is just a byproduct of a horribly managed book release.
