Well, keep in mind...you can play 40K in any "era" you choose to. It's entirely up to you when you play, and if you're a fluff-nut, you simply don't use Primaris or any "new" stuff from the continuing story line. Heck you could play the original battle of Armageddon, etc.

There's no limitation to how you play your games. Admittedly yes the tournament/pick-up game scene takes a weird twist when you show up with stuff from different eras. While we're on the subject - none of the Imperial Guard characters should still be around, though we can pretend they have those stim-treatments, etc.

It's your game, GW isn't controlling how you play it.

This is kind of why a lot of people were annoyed GW wanted to advance the "story". 40k works best as a setting, not a narrative.

Creed is also MIA, as are a bunch of other characters from different factions that still have rules.

Some characters are also on opposite sides of the galaxy from each other, and so would have no chance of meeting on the battlefield ever 'realistically'. Yet you can do that in your games.

Solomon Lok has rules, and he's dead as well.

Then you have Vect, who's the opposite. Very much alive and relevant, but with no presence in the game anymore. Not that that's at all frustrating...

Is there somewhere in the rules that tells we can ONLY play in the PRESENT TIMELINE?

As a fantasy player first, I have 0 problems playing with "historical" characters. Does it matter that one character died 300 years before the other was even born?

The battlefield in the competitive side of the game, is an abstraction, if you want to give it a narrative, then put more restrictions or create a background that works for it, like, "this Karl Franz isn't Karl Franz, it was the emperor X"

Fantasy had plenty of historical characters. Hell, even some AoS games could potentially take place in the old world if you'd like to build your army around that.

People got annoyed because they're too dumb to know that 40K is and always designed to work at point post-Heresy and not just M41? I believe it; a pretty big portion of player complaints stem from the players not understanding the game they're complaining about.
