The real loser in his is the American consumer. The article incorrectly claims that the US is the largest cell phone market, which it is not. China is. And China doesn't care about US patents. This ruling is only going to exclude US consumers from a market with greater competition, and by that extension greater selection and better prices.

Yea, I just think that ruling was made with a very large, persuasive, check. I think itd be like ruling that Macs shouldnt be made because they are too similar to Microsoft.

I counter this could be good for Samsung.

When your on top like Apple, it only hurts you in the long run. You don't get to be king of the hill forever. While they have built their brand and tech to impressive levels, complacency will set in eventually and mistakes made.

Samsung having to pay a billion in damages (and perhaps triple that much) and being forced to go back to the drawing board will in the end help them compete. Rather than copy a successful technological design, they'll have to outdo Apple at their own game. Just like when Microsoft kicked dirt in Apple's face, this may be the catalyst for Samsung to turn their fortunes around,

And Samsung is not in danger of going out of business; they lead the mobile device market and still generate large cash revenues. So they still have the tools to fight.

Let us see where Apple and Samsung land three years from now after this historic court battle and see who benefited more from Apple's "victory."

You seem to be under the mistaken impression that Apple will ever get any of that money anytime soon. I would expect an appeal and a lot of incredulous laughing.


And Apple has been complacent and stagnant since the first iPhone came out.

I doubt the jury even understands how the internal mechanics of a cell phone function, let alone be able to determine if a patent was violate. Besides, anyone with knowledge of technology patents, knows that the entire system is broken. There are companies patenting the most simplistic of ideas in the most abstract ways and then demanding that they be the only ones who can use it. The system needs reform. The way patents work breaks when dealing with hardware and software.

This is why I hate Apple.

Yeah, i really wasn't expecting them to win pinch or double tap to zoom. I figured all of the basic human gesture patents would become obvious. I don't expect all of it to survive appeals. The bounce back on scrolling didn't really surprise me though, thats sort of a non standard UI feature that was new with iOS.

It's 3:1. Samsung won the cases in South Korea, Australia and the UK. I foresee a significantly different outcome in the appeal.

Frankly the case should have been thrown out as the patent trolling that it is.
