Currently in a paypal dispute with the above user.

Trade agreed upon:
Me: $21 via paypal
Redfinger: Skorne Army Book

Issue:
Item was marked as shipped on august 28th, tracking information has not been updated since that date.
Item is now 11 days overdue, estimated delivery date of September 4th.

Current Status:
Paypal dispute opened and attempting to deal directly with redfinger.
Redfinger has told me that he has opened a USPS claim.

Other Information:

Just some advice. If he has proof of shipping, you won't win the Paypal dispute. It is very possible that it was lost in the mail. Has he given you any reason to doubt his honesty? Hope it gets resolved quickly.

This is not a problem with the seller but the USPS. So since the USPS shows that they have accepted and shipped then Paypal will side with the seller. Sorry.

I've had a similar thing happen with a WH40k Baneblade. It was sent to me with tracking, but just stopped updating at some point. The item was lost by the USPS and their "investigations" failed to find it.

The seller was nice enough to refund the money although he had no real obligation to do so.

Item Not Received Additional Requirements:
For Chargebacks, the payment must be marked “eligible” or “partially eligible” for PayPal Seller protection on the Transaction Details Page.
You must provide Proof of Delivery as described below in Section 11.4.
It is recommended that you ship the item within 7 Days of receipt of payment. Or, if the payment is for pre-ordered or made-to-order goods, shipment is required within the timeframe specified in your item listing.
c. Unauthorized Transactions Additional Requirements:
The payment must be marked “eligible” for PayPal Seller protection on the Transaction Details Page.
You must provide Proof of Shipment or Proof of Delivery.

11.4 Proof of Shipment, Proof of Delivery and Signature Confirmation Requirements.
"Proof of Shipment" is online or physical documentation from a shipping company that includes all of the following:
The date the item is shipped.
The recipient’s address matches the shipping address provided on the Transaction Details Page.
The recipient’s address, showing at least the city & state, or city & country, or zip/postal code (or international equivalent).
"Proof of Delivery" is online documentation from a shipping company that includes all of the following:
The item’s status as delivered.
The date the item is delivered.
The recipient address is the same as in the shipping address section on the Transaction Details Page.
The recipient's address, showing at least the city & state, or city & country, or zip/postal code (or international equivalent).
Signature Confirmation as described below if the full amount of the payment including shipping and taxes, is $250 USD or more, or its foreign currency equivalent provided below:

To me it says he needs proof of delivery as well as proof of shipment. But paypal will ultimately have to rule on it, I have had this issue in the past & paypal has decided in my favor.

A few things popped up to me:
He initially said I could send it as a gift to avoid paypal fees. While I know this is common I personally don't like it. Edit for clarity: I did NOT send it as a gift, I sent it as a payment.
Also in his PMs he seemed to be discouraging me from opening the case, excertped from a pm " Opening the case in paypal really wont do much, I have verification that the package was sent." - I can post a screenshot of it if necessary. While I know other people have said I might lose the dispute there is really no downside to filing one when I have a legitimate claim.

well recently for me stuff being sent as "gifts" over paypal still gets hit with fees (may be less than normal but still).

^That essentially supports your claim then.

Kind of crap if you ask me. If he did genuinely ship the item, then he has upheld his portion of the agreement. From there it is up the buyer to purchase other items to safe guard the package if indeed it is lost. With that being said, it seems Paypal will favor the Buyer even more so now. This is partially the reason I have limited use of Paypal, but to each his own.

Goodluck to both parties involved regardless of the Paypal policies.

well maybe it will come out as some a little more fair then, like a partial refund? cause both sides lost out :/

UPDATE:
Redfinger has stated he expedited the USPS claim and would be willing to provide a refund if indeed the package is lost.

In my online trading (quite extensive on Bartertown and RPGnet), if I'm selling something, I consider it on me to ask the buyer if they want insurance. If they decline insurance for the extra money, it's on them. If I don't ask them and I don't buy it myself, it's on me.

It truly sucks when the guy has evidence that he shipped the item. But in my mind, if he didn't ask you about insurance, it's on him to buy it if he wants the protection.

Dispute resolved without paypal mediation.

Package was lost by USPS, Redfinger issued a full refund.
