Probably more like the bartender fethed up while making the drink, putting far too much nitrogen in it. I don't think anyone would think it's a good idea to make a drink that starts of lethal, but gradually becomes ok to drink over time.

"Will my drink still kill me, or is it ok to drink it now?" is not a good recipe for repeat business.

That's what it sounds like to me. Gonna be a HELL of a class action law suit.
