I doubt it. Does it target a unit? If so, it almost certainly needs Line of Sight, and you can't get Line of Sight for a non-witchfire power from inside a transport.

Wasn't there some FAQ regarding powers but not shooting powers from inside a transport at one time? But now I can't find it.

But it's not a power, it's just something that happens. I'd say that as long as your spirit seer is alive, you can spirit mark any unit that lies within the given range of 12". As far as I'm aware, there's no rules regarding limitations of a "nomination".

It's in the psychic power rules under Pick a Target. ifroget the page number off hand. Long story short, if embarked and the power requires LOS a psyker can only cast it on himself, his unit, or the transport.

Psychic powers by default require LOS. If the power does not say you don't need LOS then you do.

As it is I do not own the supplement so I can not answer anything directly from that.

Spirit Mark IS NOT a psychic power. It's an innate ability that affects other units, much like Mind In The Machine.

I was answering camarodragons question. Usually when somebody refers to "powers" in warhammer 40k context, they are referring to psychic powers. As I said I don't own the supplement so I don't know what is a power, what is not, who can be affected, etc.

Spirit Mark is not a shooting attack and does not require Line of Sight, so there appears to be no problem using it from inside a transport vehicle.
