You can be.

There is just no realistic way of enforcing it.

We install "ignition interlock" devices on the vehicles of serial offenders that require that you blow into a breathalyzer before the car will start, but that doesn't keep you from driving any other car or getting your sober buddy to blow it for you.

Even a crazy "swipe your card, take your fingerprint, blow into the breathalyzer" car could be beat unless you require the driver to keep all 10 fingers on special fingerprint sensors that are installed on the steering wheel to prevent a friend from starting the car for him.

And then you'd have to deal with the expense/awkwardness of maintenance (by a certified establishment!) and what happens when the whole system goes wrong.

And Mythbusters already showed that you can fake out the fingerprint sensors anyway!
