Just going to post the updated bit:

The Austin American-Statesman explained that police looking for drunk drivers had attempted to pull over the suspect at a nearby gas station. According to the police report, the driver weaved through the gas station, went the wrong way down one street, then turned up Red River, which was closed to vehicle traffic.

He drove two blocks through the pedestrians and at 11th, he struck a moped with a man and woman, who both died at the scene, Acevedo said.

The driver kept going, hit a taxi and a parked van, before jumping out of the car and fleeing on foot. The same officer who initiated the stop chased him all the way through and tased him, the police chief said.

Austin Police Chief Art Acevedo said the driver will face capital-murder charges for the deaths and 23 counts of aggravated assault with a vehicle. Authorities say a large portion of Red River will be closed for most of the day Thursday.

Amidst the mists and coldest frosts he thrusts his fists against the posts and still insists he sees the ghosts.

Well the charges actually have to be met. Capital murder has an intent/mental state that is a higher level then this.

They will charge with everything then likely settle or he will be more likely convicted on plain murder. CAVEAT: they could get cap murder if he's convicted of another of a list of feloney level crimes or ubnder the subsectiosn for multiple murders in the same incident. I am not an criminal defense attorney and do not know the full permutations here, but he will be hammered with as much as possible.

Intoxication manslaughter is the texas crime for killing someone while driving under the influence. Now given that he was actively trying to escape the police while he did it, they may be able to go further then that.

Basically, because of the lengthy legal process required to 'ensure there's no false excutions' (stop laughing back there) it costs a lot more to go through the process of executing somone than it would to keep them in prison for the rest of their lives.


You know, it's instances like this where we just need some Megacity One Judges.

Seriously. Dude is unequivocally guilty. Put the fether down. A 9mm round costs around 24 cents.

Yeah, I actually used to be all for the death penalty, till I realized how much more it costs than Life in prison.

I do like the one bullet to the head idea. Then bill the family for the cost of the bullet.

This is going to be a slam-dunk case wise though. Texas Jurors are not going to be the forgiving sort in this mess.
