As i have sold of most of my 40k im looking at starting a heresy army, would heresy lists be accepted in 40k games and tournaments or is it 40k sticking to 40k, seems the standard marine codex's are so dull compared to heresy

In tourneys, highly unlikely. Friendly game stores, depends on your opponent really.
I'd play against it for fun but some might not.

Every tournament makes up it's own inane rules, so you can't get any kind of single answer there.
As for regular games, no one should have any issues with it. The Legion and AdMech armies are very low powered. I'm not saying no one will have issues with it, just that they shouldn't.

This is an actual rule in the actual rulebook. Quit whining about how you can imagine someone's army touching you in a bad place and play by the actual rules.

This is true, technically, but I have never seen a tournament that allowed 30k lists. Some events seem to be allowing Imperial Armour army lists now, and I think that this will become more common over the next year or so. After this becomes accepted, more people will probably gravitate towards allowing 30k lists in regular games, but it's not happening any time soon.
Really, though, there's no major balance issues. The 30k lists are fine, but I've played against them with my Ultramarines and, especially compared to Tau and Eldar, the 30k army was no problem at all.

The only real issues is that 30K armies still pretty much fall before Tau and Eldar as I've learned, but the have some tools to help fight back.

The 30k lists don't have the '40k legal' stamp, Forge World themselves have said this is because the lists are designed for balance within the 30k setting, not for balance with 40k lists.
Given that it can still be an uphill struggle to get people to accept stuff the FW say is 40k legal, I can't see 30k becoming widely accepted anytime soon.

I played a game against the AdMech today, it seemed like a decently balanced list. Your main problem is that people are already somehow afraid of FW stuff, and when it doesn't have a 40k legal stamp that can really be a problem.
So, if you want to play in tournaments, don't get a heresy army, if you have a gaming group that knows you, go for it!
