TALLAHASSEE, Fla. (AP) -- Florida officials are appealing a federal judge's ruling that a state ban on gay marriage is unconstitutional.

Attorney General Pam Bondi's office filed the notice Thursday on behalf of Surgeon General Dr. John H. Armstrong, Secretary of Management Services Craig J. Nichols and Washington County Clerk of Court Harold Bazzell.

U.S. District Judge Robert L. Hinkle in Tallahassee ruled on Aug. 21 that the ban violates the 14th Amendment's guarantees of equal protection and due process. Hinkle issued a stay delaying the effect of his order, pending possible appeals.

A number of similar rulings around the country have been put on hold while appeals are pursued.

Florida Voters approved the ban in 2008.

This isn't about winning the court case (there's no realistic hope of that), it's about making an ideological statement to a necessary group of voters. The fact that it's an obscene waste of taxpayer money doesn't matter, which is hilarious irony given how the people doing it so often talk about small government and fiscal responsibility.

My question is why is this even allowed as a vote if the end result is expensive legal battles when the ban wins in an election only to be later overturned in court?

Because you can vote about anything. The occasional idiotic waste of taxpayer money on a law that was doomed as soon as it was passed is the price we pay for not being told we're only allowed to vote for the things that our all-knowing masters approve of.

It is frustrating though. It seems there are better things to be done on the taxpayer dime than pissing it away on pointless votes and court battles that inevitably follow.

State questions serve two purposes:

1) you get to pass unpopular or controversial laws while also washing your hands. You can't be held liable for a vote that the people decide even if you put it on the ballot.
2) it's a great way to make people that will vote for you to show up at the poll. People might not care enough about governor races to show up and vote. But they care about guns, they care about gay marriage (for and against), they care about pot. So you put a highly partisan issue on the ballot and people who care strongly will come out and vote. And hey, since they are already voting they might as well vote for the candidates from their party.

It's a popular tactic used by both sides.
