While the gaze of death is used in the shooting phase it does not state that it is a shooting attack. Can the gaze be used in close combat as well?

From how I understand it. It isn't a shooting attack, it doesn't say anything about firing or shooting in its rules.
its rules are simply (paraphrased): During the shooting phase pick a unit and it looses wounds equal to 3d6 -unit's LD. And there is no restriction other then those so from what I can see it can be used if the C'tan shard is locked in combat as well as be used on a unit that is locked in combat since it is not a shooting attack.
I suspect this to be FAQ'd later maybe? But currently makes the C'tan shard more appealing to use with assault based necron list.

It's easy to assume that people arguing an interpretation you disagree with are just looking for an advantage for themselves... But it's quite often not the case. |

Good point, since it doesn't need to hit and just says "a unit within 12" and Line of Sight".
Worth noting, that while the Deceiver is less useful than the Nightbringer, his bubble of -2LD assists Nightbringer. Throw in a Deathbringer Formation (-1LD bubble around the flyers), and Gaze of Death can do some serious damage, even if it is gimmicky.

That might conflict with the rule that weapons and powers that auto-hit or hit on a fixed number can't target flyers and fmc.

Edit: I just checked the wording. "Template and Blast Weapons, and any other attacks that don't roll to hit, cannot hit Flyers". Don't roll to hit would be like old Death Ray, or a Beam power. And thats for Flyers. Under FMC, it doesn't even say that. And, because this isn't an attack, but a special rule, so to speak, I'm assuming it would work. I pulled a search of my book, and got this under Hard to Hit, Zooming, Flyers:
Template and Blast weapons, and any other attacks that don’t roll To Hit, cannot hit Zooming Flyers.
Doesn't specify really. The FMC protection of the same name (in their case swooping, not zooming) grants even less- and those are the ones you'd be targeting anyways.

Yeah, the FMC one just says "Shots resolved at such a target can only be resolved as snap shots unless Skyfire". This isn't a shot, it's just a roll.

The great thing is, he'll never need to fire at zooming flyers, so that distinction is already null.
Now FMCs, which he can damage and target, they have to take the test given los and range.
It's a neat thing alright, especially considering that the Crons just had their reliable ground-to-air option taken from them. It still won't do a thing against armour. :(

It can't target Flyers anyway, since it specifically says "non-vehicle unit". FMCs have no such rule preventing them from being hit.

Well, if we follow this argument still, there's still the fact that it isn't an attack. Nowhere does it state it. It just merely happens, and it tells you which phase it happens in.

Sad thing is, this is one of the things with controversy that I don't see being FAQed. They worded it a specific way for a reason, I can only assume.

Sad panda that night bringer is unique. Bash brother combo is still pretty nice but expensive.
Nightbringer + conclave and some tricked out crypteks can be pretty nasty as someone posted in the tactics thread.

Uh.. how? Gaze of Death only effects a single enemy unit within 12". Unless you mean in a Necron vs Necron, Nightbringer vs Nightbringer game.

That's old, Blast Template Gaze of Death. This is new, point at a target and free Psychic Shriek Gaze of Death.
