Pretty much what Bob said.

Legally I can't write (well can't write and distribute) the further adventures of Harry Potter or Bilbo Baggins, but I can certainly write, distribute and sell the adventures of Larry Porter, Boy Wizard or Gilbo Gabbins, Hobbit adventurer.

Copying a work is out, but stealing an idea, that's legal as sea salt.

Without stealing ideas, there'd be on Warhammer Fantasy!

The problem is less if it's legal, than if you can afford a lawyer and say it's legal. Usually, it's just less expensive to not continue to carry the line.

The BBC have a duty to protect their IP. As such they have to take legal measures towards that end. They will also have legal obligations to the licensor of their IP. Visa versa too.

Garbage sculpting or not, It isn't warlord sending the C&D's.

Take the opportunity to buy up what you can, bemoan Warlord for the quality of their sculpts. The alternative is to just buy something else from Not Who manufacturers and support them that way.

There's also a 'right' and a 'wrong' way to enforce intellectual property rights.

Games Workshop (Chapterhouse) and CBS/Paramount (Axanar) skipped right past a C&D and straight to a lawsuit, which is basically the worst way to handle it. And you can see what it did to GW in the long run.

This C&D from Jack Daniels is a really great example of how to enforce and protect intellectual property rights while also being respectful of others, respecting the inherent limitations of intellectual property rights, respecting the power disparity, and ultimately building their brand and goodwill.
