Can I do it? If not, can Mallex's underlings mess up a detatchment if it is Black Legion ?

You cannot due to the Designers Commentary since Servants of the Abyss is not a Chaos Space Marine Legion (or Renegade Chapter). If by underlings you mean the Black Legionnaires, they have the BLACK LEGION keyword (as does Mallex) you can have them in a BLACK LEGION detachment just fine, so it's a moot point.

You do realize that both Obsidius Mallex and the Black Legionnaires have the 'Black Legion' faction keyword?

If by "underlings" you meant the Traitor Guardsmen, then you're out of luck since you cannot pick "Servants of the Abyss" as a <LEGION> due to the Designers Commentary.

Damn, looks like the Servants are strictly Blackstone Fortress only.

You can take them in an Auxiliary Support. Probably not worth it though!
