For example, can GW send you a C&D if you use, say, the Warhammer 40,000 logo on your website? What if you have the disclaimers provided by GW on your site? Would having Google Ads affect this?

It doesn't matter if you have a disclaimer, you still need their permission to use it first otherwise they'll see it as using their IP without their permission and give out a C&D.

So what if you just have Text saying "Warhammer 40,000" (which is what they have trademarked) they can send the lawyers after you?

Disclaimer means nothing.
It just basically means " i acknowledge this TM item doesnt belong to me , but im still going to use it without permission anyways "

Usually fair use applies in academic use (essays), free press (reviews, news, etc...), and a few other situations.

Derivative works is not covered in fair use in any way, even if it's free.

There's a whole section of the GW website dedicated to explaining what you can and can't do with their IP.

There's nothing in there particularily inaccurate under British or American trademark and copyright law.

The answers to all of those questions depends on the country and jurisdiction in which you and your website reside.

If you'd like a legitimate answer, hire a lawyer. If you're content to get answers from people who might be twelve year old kids, well, then you've asked in the right place.

I wouldn't risk it, is the operative word. GW doesn't deserve fansites, anyway.

The supply does not get to make the demands.

Yup. Best advice going is to ditch the fansite and to ditch GW as well. Take up a game produced by a company that actually gives a stuff. It'll work out better for everyone in the long run...

GW is a Brittish Company, so don't the laws apply only in Britain?

Um, guys, er, um, in case it wasn't obvious, this is a GW fan site, the one you posted those comments on. Oh, the irony.

Almost as amusing as the posts I see on here that say, "I haven't bought or played with anything from GW in years, but blah blah..." and then they go on to to complain about this or that. If you dropped GW products for another hobby years ago what are you doing hanging around on a forum nearly solely dedicated to GW products? When I drop a hobby, I drop it, I don't hang about on forums for things for which I have no interest and which I don't buy. It's totally irrational to be hanging around Warhammer forums years after you got out of the hobby.

GW is Her Majesty's premier miniatures retailer! They are above the law!

We're not very big on official rules. Rules lead to people looking for loopholes. What's here is about it.

So you're say, By Law, we can't make conversions of GW figs using bitz from other companies?

Depends on the country, and the country your hosted in.

Once again a Cease and Desist letter carries no legal authority unless it comes from a court who's jurisdiction you recognize.
