A bad case of road rage leads to sword fight
AUSTIN (KXAN) – An argument in North Austin turned medieval Friday, when one man was struck and severely injured by a “double-sided sword,” according to an arrest warrant.
Police said Joshua Mejia, 23, struck the victim with a 34-inch sword during an argument over the victim’s car blocking Mejia’s driveway at 1909 Hearthside Dr., which is located near the intersection of U.S. Highway 183 and Payton Gin Road.
The victim poked Mejia in the chest with his finger during the altercation, according to the affidavit, and then Mejia struck the victim in the upper arm with the sword. The weapon had a handle in the center and about 13 inches of blade on either side, according to the affidavit.[i][u]
Police found the victim bleeding heavily and lying in the driveway. The sword sliced an 8-inch gash in his arm and cut through bone, according to the arrest warrant.
Mejia has been charged with aggravated assault with a serious bodily injury, police said.

The stupidity of people amazes me sometimes. If you are unable to identify someone as being crazy for walking around with a sword - you deserve to get stabbed.

Why was he charged? I thought Texas was a "make my day" state and if someone is on your property, offers you violence (poking someone with a finger is battery under the law), you can pretty much do what you want with them.

To be fair, I think they have to be in your house but you can always shoot them in your yard and drag them across the threshold.

Further, in Texas women have the "he needed killin your honor" defense. Once this is invoked and proof of Texas citizenship is confirmed. the constabularies have no choice but to release the woman and return her firearm. If she only winged him, they are required to direct her to the nearest shooting range to improve her accuracy. Don't blame me. Its the Law.

It's not true. And Texas is a great state. If you never go, you're only hurting yourself.
It is true, to an extent.
You still have a legal right to exclude or remove trespassers from your land; however you are limited to only using non-deadly force to do so. The use of force can have many different manifestations, from physical confrontation to displaying a weapon. Texas Penal Code §9.04 states that for defensive purposes the display of a weapon in order to create apprehension in another person is considered a use of force, not deadly force. That means if someone trespasses on your property, you may display your firearm to create apprehension that you will use deadly force if necessary. You will not be legally justified in discharging the firearm, but you will be legally justified in displaying it to “create apprehension” under the law. Only if the trespasser is committing other acts where the law states that you are justified in using deadly force would you be allowed to discharge your firearm legally.
The guy poked him which is battery under the law and was standing on his property when doing so, he was within his rights under Texas law to stab that sucker in the arm. That doesn't mean he won't be charged for it, initially, because the law just provides legal justification, he'll need to defend his reasoning in court but will more than likely see the charges dropped, depending upon evidence, witnesses, etc.
If you can wave a gun around, I suppose you could wave a sword around too...

Texas code even has a no dueling clause.
Texas Penal Code §9.31:
The use of force against another is not justified if you consent to the force. (No dueling or consenting to gun fights).

You have to remember that duels were a perfectly acceptable thing for thousands of years, and were only illegal for the last 150ish years. And even then they still happened for a while even while they were illegal. That classic western gunslinger duel in the street isn't a complete myth, mostly, but not complete.
That law is almost certainly quite old, but its not a bad thing to keep around. You because if the law doesn't forbid consenting to gunfights you know someone somewhere will engage in one. And they will likely get off scottfree if this law doesn't exist.
