I couldn't fething believe this when I read the news today! Talk about frivolous lawsuits, and of course violation of privacy! For those of you who will be to lazy to read the article the summary is as follows: Mom and daughter are suing a landlord because their neighbor smoked next door. The neighbor was in her own apartment, there was no rule prohibiting smoking and the mom and daughter are now claiming they are disabled. The story puts it in greater context, but I still think this is just plain stupid. How you have sunk to a new low fellow Texans!

California is the worst state. It is too bright, there are TONS of hippies, fresh air, sandy beaches, fresh fruits, vegetables and seafood available daily, and a very awesome music scene. Awful place...
Seriously, this thread is about the pansies in the article linked above. I find it recockulous (California word. See: Redonkulous) that the woman was issued a restraining order against smoking in HER OWN HOME!!! Personally, I smoke. I wish I didn't, but gak is so stressful right now. I digress.
Smokers are the pariahs of our society. I am judged as being less of a human being because I smoke, not that I give a feth. Though, I do think that is wrong. I think what those b  s did was wrong. I HATE the smell of China Town in Oakland on garbage day, but I am not going to get the store owners banned from putting their garbage in the streets.

Feth this. The woman bringing the suit is acting too ridiculously.
She renews the lease halfway in... despite being "disabled" by the smoke? Laughable.
Later putting on gas masks to retrieve her things from a room that has cigarette smoke in it from next door? More laughable. It's the most transparent stunt I can think of.
I feel sorry for the smoker, and the complex owner who had to try and seal off the room for someone who needs a new brain more than a new set of lungs.

I wonder however if it will set some sort of legal statue,smoke free apartment complexess,owners refusing to rent apartments/homes to smokers,or more likely "price increases" for renters who smoke "nececary" to "get that nasty smell out" when the smoker moves out.

Ok OT. I do not smoke. I understand no smoking in restaurants and the like the do not have a self contained smoking room with seperate ventilation.
But telling someone that they CANNOT smoke in there own home? WTF is wrong here. How the hell is THAT constitutional? Someone needs to execute that ladies daughter infront of her, tell her something heroic, and then end hers as well. Thatll give Americans a lesson that they wont forget..... well not until a week later.... how long did we hold onto 9/11?

I could file a suit saying 'I want a million dollars from DakkaDakka because there aren't enough threads complaining about the Space Wolves' but it wouldn't mean I have slightest chance of getting any money off anyone. I think we need to start being outraged if this gets to court.

Good point. I mean, she's obviously causing a lot of inconvenience to people regardless, but nothing's been handled badly yet from a legal standpoint, it seems.

Well here is the thing. I actually sent this to a client of my dad's, who is a trial lawyer, and he had this to say. "Thanks for the e-mail. I am still surprised, even in my old age. While I don't think that any jury in the world, or judge for that matter, will consider this to be a realistic case, you still have to leave that as an open option. The more realistic avenue is this: Yes the landlord will win in a courtroom, but they will have to pay a tremendous amount of money in court and lawyer fees. They will probably settle out of court, and this idiot lady and her gravy-for-brains daughter are going to walk away with a bunch of money." So yes sebster, you are right that this will probably never go to court, but since it isn't a "loser pays" system they don't need to worry about it. Sucks to get sued....

Yeah, fair point. It'd be nice if tort review systems could throw out a lot these nuisance cases before the lawyer fees started building up, but that's fraught with danger.
